Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the AiKYNETIX platform, including the web application, mobile application, and any related services (collectively, the “Service”) operated by AIKYNETIX LLC (“AiKYNETIX”, “we”, “us”).

By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account, signing in, uploading content, or otherwise using the Service, you confirm that you have read, understood, and accepted these Terms. If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Description of Service

AiKYNETIX provides automated biomechanical analysis of athletic motion. Coaches and clinicians upload video; the platform extracts pose keypoints, computes movement metrics, and renders an annotated session for review with their clients. The Service is a coaching aid intended to assist qualified coaches and practitioners; it is not a diagnostic medical device.

The Service includes:

  • Web application at app.aikynetix.app and any subdomains.
  • Video processing pipeline and metric computation.
  • Session storage, dashboards, and reporting surfaces.
  • Stripe-managed billing and subscription handling.

3. Accounts and Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. The Service is not directed at children under 13 and we do not knowingly collect data from them (see the Privacy Policy).

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us at info@aikynetix.com as soon as you suspect unauthorised access.

4. Acceptable Use

You agree not to use the Service to:

  • Upload content for which you do not hold the necessary rights or consents from the people recorded.
  • Upload content depicting illegal activity, abuse, or material that violates third-party rights.
  • Attempt to reverse-engineer, scrape, or bypass technical limits (rate limits, quotas, authentication).
  • Share or resell your access to the Service without our prior written consent.
  • Use the Service to draw clinical or medical conclusions; the Service is a coaching aid only.

We may suspend or terminate access for breach of these rules without prior notice when necessary to protect the Service or its users.

5. Subscriptions and Billing

Paid plans are processed by Stripe. By subscribing you authorise recurring charges on the payment method on file until you cancel. Pricing, plan tiers, and quota limits are published in-app and may be updated with advance notice.

Session quota is tracked through an append-only ledger; each video analysis debits one session from your current balance. Quota does not roll over beyond what your active plan specifies. Refunds for unused quota are at our discretion outside of statutory consumer-protection regimes.

You can cancel at any time from the in-app billing portal. Cancellation takes effect at the end of the current billing period; you retain access until then.

6. Your Content and Licence

You retain all rights in the video, athlete data, and any reports you upload to or generate through the Service (“Your Content”).

You grant AiKYNETIX a limited, non-exclusive, worldwide licence to host, process, analyse, and display Your Content solely to provide and improve the Service for you. This licence ends when you delete Your Content or close your account, subject to short retention windows required by law or for backup integrity.

We do not use Your Content to train public models or sell it to third parties.

7. Coaching Aid Disclaimer

The Service produces biomechanical readings (joint angles, cadence, displacement, force estimates, and similar) for the purpose of coaching feedback. These readings are not medical diagnoses, not clinical assessments, and not a substitute for professional medical advice. Decisions about injury, return-to-play, treatment, or medication must be made by qualified medical professionals; the Service is not certified as a medical device under any regulatory regime.

8. Limitation of Liability

To the maximum extent permitted by law, AiKYNETIX is not liable for indirect, incidental, consequential, or punitive damages, including loss of profits, data, business opportunity, or reputation, arising out of or in connection with your use of the Service.

Our aggregate liability for any claim related to the Service is capped at the amount you paid AiKYNETIX in the twelve months preceding the event giving rise to the claim, or one hundred US dollars — whichever is greater.

9. Termination

You may stop using the Service and close your account at any time from the in-app settings or by contacting us.

We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that risks harm to other users or the platform. We will notify you when reasonable to do so.

On termination your right to use the Service ends immediately. Rights, obligations, and limitations that by their nature should survive termination remain in effect (including content licences for backup integrity, liability limits, and dispute-resolution provisions).

10. Governing Law

These Terms are governed by the laws of the jurisdiction in which AIKYNETIX LLC is established, without regard to its conflict-of-laws rules. Any dispute arising under these Terms is subject to the exclusive jurisdiction of the courts of that jurisdiction, unless mandatory consumer-protection law in your jurisdiction applies.

11. Changes to These Terms

We may update these Terms from time to time. The updated Terms become effective on the date posted. For material changes we will provide reasonable advance notice through the Service or by email. Continued use after the effective date constitutes acceptance of the updated Terms.
